These terms apply to all sales by Eye Image UK Ltd to the exclusion of any other terms unless otherwise agreed in writing. By placing an order you agree to these Terms and Conditions which form the only agreement between us. Eye Image UK Ltd reserves the right to make changes to the items shown on this website and to remove selected styles. We have made every effort to ensure that the colours and images used on this website give a good representation of the products themselves, but we cannot guarantee this due to monitor resolution and brightness.
Delivery
Eye Image UK Ltd will endeavour to advise delivery dates on acceptance of your order. We will normally deliver goods within 5 working days subject to the goods being in stock. For embroidered or printed goods please allow 10 – 15 working days subject to goods being in stock. If there is going to be a delay for any reason we will advise you. Made to measure and special order items may take extra time and we will advise at the time of order.
Goods are delivered by a next day carrier service or Royal Mail Recorded Delivery or DPD, usually providing delivery the next working day, Monday to Friday, and is available within most areas of mainland UK free of charge for orders of clothing over £300.00 excluding any set up costs and VAT. For orders under £150.00 delivery is £7.50 plus VAT. For orders under £150.00 excluding VAT to The Highlands and Northern Ireland delivery is £20.00 plus VAT. Subject to any fuel surcharges applied by the carrier.
In the event that the carrier is unable to deliver to you and a second delivery journey is required, or if the second attempted delivery is unsuccessful, in which case the goods will be returned to Eye Image UK Ltd, additional carriage charges incurred may be charged to you.
Eye Image UK Ltd will not be liable for any consequential loss caused by failure of the carrier to deliver.
Eye Image UK Ltd. reserves the right to deliver the goods in reasonable instalments, in which case you shall accept and pay for the goods in reasonable instalments. Each instalment is to be treated as a separate contract.
Any claim for non-delivery of or damage to the goods in transit should be made within seven days of the date of the invoice or delivery date if later. Our liability in respect of any such claim is limited at our option to replacement of the goods or refund of the price and does not extend to any indirect or consequential loss.
Price
The price of the goods will be the price ruling at the date of order. All prices quoted exclude carriage, post & packing and VAT. Any applicable post & packing, carriage, and VAT is payable by you in addition to the contract price.
Any additional services such as personalisation of garments, alteration to garments, man-packing etc. will incur an additional charge. Prices for these services will be confirmed at the time of ordering.
Payment
Full payment is due at the time of order unless other terms are agreed in writing.
Account customers invoices will be issued on the day of dispatch of the goods and must be paid in accordance with the agreed terms.
If you fail to pay us in full on the due date:
1. We may suspend or cancel future deliveries;
2. We may cancel any discount offered to you;
3. You must pay us interest at the rate equivalent to that set for the purposes of Section 6 of the Late Payment of Commercial Debts (Interest) Act 1998; a) calculated (on a daily basis) from the date of our invoice until payment; b) compounded on the first day of each calendar month; c) before & after any judgement (unless the court orders otherwise).
If you have not paid Eye Image UK Ltd. all amounts due on an invoice and 45 days have passed since the due date for payment then Eye Image UK Ltd. has the right to charge you an administrative fee.
Where copy invoices are requested faxed copies will be provided free of charge, however there will be a charge of £1.50 plus VAT for copies required to be sent by post.
You are to indemnify Eye Image UK Ltd in full and hold Eye Image UK Ltd harmless from all expenses and liabilities Eye Image UK Ltd may incur (directly or indirectly and including finance costs and legal costs on a full indemnity basis) following any breach by you of any of your obligations under these terms. You are not entitled to set off any debt or claim against other amounts owing to us.
Risk & ownership
The risk in the goods passes to you when the goods are delivered to the delivery address. Ownership of the goods remains with Eye Image UK Ltd until payment has been received in full for the goods and any other garments for which payment is also due.
Your data
We will do our utmost to ensure that we deal with you in a safe way. Our computer systems are protected by a firewall that is designed to prevent unlawful access to our computer held records. We cannot, however, guarantee that such an event will not occur and will not accept any liability of any loss thus caused.
Our anti-virus software scans all emails before transmission but we cannot be held responsible for any damage or loss arising from such an event occurring.
We will not share or make available the information we hold on our database with any other company or organisation unless under court order.
Insolvency
If (a) you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order, or go into liquidation; or (b) you cease, or threaten to cease, to carry on business; or (c) Eye Image UK Ltd. reasonably believes that any of the above events is about to occur and notifies you accordingly; then you shall cease at once to use any goods not then paid for and shall on demand return any of them remaining in your possession. On making such a demand, we are entitled, without incurring any liability to you, to enter your premises and remove and repossess such of our goods as are to be found there, and also to cancel any contract with you.
Force Majeure
Eye Image UK Ltd will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond the control of Eye Image UK Ltd.
Returns policy
If any garments are not required for any reason we will be happy to replace them or to refund their value less original delivery cost provided that; (a) they are returned to us in their original packing carriage paid, unused (other than for the purpose of trying on the garment), within 10 days of delivery; (b) our invoice relating to the relevant goods has been paid by the due date; and (c) a written note is enclosed quoting the invoice number and stating the reason for the garments being returned. In the case of return of one or more garments, a handling charge(25% value) relating to the administration costs incurred may be applied by Eye Image UK Ltd. Goods returned are done so at your risk and you are advised to use a service which provides a guarantee of delivery. This returns policy does not apply to bespoke styles, embroidered or printed garments, altered or personalised garments.
Cancellation
If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the contract and receive a refund. You must inform us if you wish to cancel within 7 days, starting on the day after the goods are delivered to you. If you choose to cancel then the goods must be returned to us in their original unworn condition and with all packaging and tags etc. intact, together with your receipt. Please note that carriage costs can only be refunded if the goods are faulty.
If an order for a bespoke style, embroidered or printed garment, personalised or altered garment is cancelled for any reason you will be charged for any garment, labour or fabric costs that have been incurred in processing the order up to the time of cancellation.
Distance Selling Regulations
Our returns, refunds, and cancellation policy is in accordance with the Consumer Protection (Distance Selling) Regulations 2000. These regulations apply to transactions within the UK where the consumer does not meet the vendor. Transactions between businesses are not governed by these regulations.
Warranties & Liability
Where a guarantee is given that exceeds your entitlement under English Law such guarantees are offered by the product manufacturer and not Eye Image UK Ltd. We will assist you in pursuing any claim you have under a manufacturers guarantee.
This site is published with the intention of assisting you, our customers, and all information is provided in good faith. We cannot guarantee the accuracy of the information or suitability for purpose of any product. We, any of our staff or directors will not accept liability for any loss or damage arising from the use of this site or the information within it.
Samples
Any samples requested will be invoiced to you on dispatch and will be credited in full provided they are returned to us unused within thirty days of delivery otherwise the price, including any applicable post &packing and VAT becomes immediately payable.
